The new updated AWR legislation is due to come into force on 1st October 2011. Back in December 2008 they implemented the Agency Workers Directive, which then became European law.

The AWR legislation is aimed at providing temporary agency workers with the right to equal treatment the same as the equivalent permanent worker. This comes into effect only after completing 12 weeks on an assignment.

The Government is legally required to implement larger parts of the AWR legislation, for that reason APSCo believe any more changes are unlikely to be significant. A draft guidance of the Agency Workers Regulation is confirmed by the Department of Business, Innovation & Skills to be published in February/March 2011. Leading on to finalisation of the AWR being published in April/May.

Astonishingly, considering the importance of the AWR, recent research by staffing agency Adecco indicated 61% of interviewed companies were unaware that the new AWR will come into action in less than 12 months time. Furthermore, 80% of HR workers had no idea of the implications of the AWR and its effects on temporary workers.
