One more lawsuit has been filed against Bayer Corporation, manufacturer of Yaz related to side effects of using Yaz. This lawsuit has been filed in Texas. Bayer produces two popular oral contraceptive pills, Yasmin and Yaz. Both of these drugs have triggered a substantial controversy over the severe side effects they produce. The plaintiff in this recent case was a Texas resident who alleged that use of Yaz/Yasmin has resulted in her gallbladder removal in 2006 after she suffered from severe pain in stomach.
Both Yaz and Yasmin are new generation oral contraceptive pills, which contain synthetic progestin called drospirenone. Other active ingredient in these pills is ethinyl estradiol. When combined, these ingredients said to have severe side effects such as gallbladder diseases, gallstones, and blood clots. Their use can cause gallbladder diseases like cholecystitis (inflammation of the gallbladder) and cholelithiasis (gallstones). In some cases, the patients may ultimately have their gallbladder removed.
Drospirenone is believed to develop blood clots, which can cause fatal results if they travel to heart or lungs. They can also damage to the liver or kidney, as drospirenone blocks the hormone aldosterone in the kidneys.
Thousands of Yaz and Yasmin lawsuits have been filed against Bayer Pharmaceuticals. More than 1500 such lawsuits are related to gallbladder diseases. To date, more than 4,000 Yaz/Yasmin lawsuits have been consolidated under Judge David Herndon. He is a US District Judge for the Southern District of Illinois, who was selected to preside over all Yaz and Yasmin cases filed in federal courts. The Yaz and Yasmin lawsuits involve not only gallbladder injuries, but also cases of blood clots, pulmonary embolism, strokes and heart attacks.
The recent Texas lawsuit was filed by Lana Speck of Galveston in state court. Ms. Speck claimed that the use of Yaz resulted in gallbladder disease and, later, the removal of her gallbladder. Speck has filed her Yaz lawsuit on January 31, 2011. This suit was filed in County Court at Law No. 1 in Galveston County, Texas. Her lawsuit accuses Bayer of not providing adequate information to patients and medical professionals of the health hazards and severe side effects produced by Yaz and Yasmin. Though the pharmaceutical giant had knowledge about the severe side effects these medicines can produce, it failed to provide the information prior to the sale and distribution of the drug to Speck.
Speck has also alleged that she is still suffering from constant severe chest and upper abdominal pain as a side effect of Yaz. She suffered from gall bladder disease as a side effect of using Yaz. This led to her gallbladder removal in 2006, but she was not relieved from pain and suffering. Instead, the removal of her gall bladder has resulted into constant severe chest and upper abdominal pain. She also suffered from other digestive problems as a side effect of the drug. She used this contraceptive drug for 7 years and suffered a long spell of crippling abdominal pain and post-cholecystecomy syndrome after removal of gallbladder. She is seeking medical expenses as well as compensation for her pain and suffering. Powers Taylor LLP was not involved in the filing of Ms. Speck’s lawsuit.
Yaz and Yasmin have been sharing a one-third of market share of the oral contraceptive market. Though thousands of lawsuits have been filed against Bayer regarding these drugs, these medicines are still being sold and are earning a large amount for Bayer. Bayer is still arguing that it has provided adequate warnings regarding side effects of these drugs on their label. But the number of lawsuits is increasing day by day, most claiming that the warning is not adequate and doesn’t inform women or their doctors about the severe side effects.
