Zimmer Lawsuits Could Result in a Multi District Litigation

A status conference associated with several Zimmer knee recall lawsuits was slated for July 6, 2011 and presided over by the Judge Joan K. Leflow. Illinois resident Fred Stone filed this lawsuit. It is expected that Fred Stone’s attorney may ask several similar suits be combined into multi district litigation. The status conference would be held in Illinois among Zimmer knee lawyers, the Zimmer holdings, the manufacturer’s attorneys and Judge Leflow. The judge is expected to determine the exact status of the proceedings, trial date, court venue and tentative length of trial proceedings.

The Zimmer knee implants are used in knee replacement surgeries to give patients relief from problems of knee joints. Zimmer offers a minimally invasive solution through many Zimmer knee components. They have been developed as per requirements for minimally invasive surgery. Zimmer MIS Solutions are designed to facilitate implantation through a smaller incision so that muscles and tendons around the knee are not damaged. These knee components are claimed to give patients a relaxed and better life.

The Zimmer NextGen CR-Flex Porous Femoral Component is one of the knee implant component from Zimmer. It is a non-cement piece, which is attached to the bottom of the thighbone. It is linked with several implant problems and a high rate of implants failure. It is said to have a 9% rate of implant failure. This high rate of implant failure is said to be due to design problems with the Zimmer NextGen CR-Flex replacement knees.

There has been a constant demand for Zimmer NexGen knee replacement recall from doctors and patients in a similar fashion. Many patients having these implants have complained of pain and loosening of their Zimmer NexGen knee replacement. A study has been conducted in this regard involving 108 knee replacement surgeries using the Zimmer NexGen CR-Flex Porous Femoral Component. 9 patients were found to have a requirement of revision surgery and 39 patients had radiographic loosening knee implants.

Fred Stone is one of 28 people who have filed a lawsuit against Zimmer Inc. for a recall of Zimmer knee components in Illinois. There are so many of Zimmer knee recall lawsuits pending in the jurisdiction of Illinois. There are chances that the Zimmer knee lawyer in Illinois could ask the court to consolidate the lawsuits in a multi district litigation, in the status conference. But Judge Leflow is not expected to give a decision on the matter right now.

It is expected that the Judicial Panel on Multi District Litigation is not going to meet in near future at least till the end of July 2011. They would hold a meeting in San Francisco, it is expected. If the judicial panel grants the request of the Zimmer knee lawyer in Illinois, to consolidate at least the discovery portion of the Zimmer knee recall lawsuits in a multi district litigation, it will be going to save time and effort. It will also save from the contradictory jury opinions. But if the request is refused each lawsuit attorney has to go through legal proceedings individually.
